管轄条項の対案で、被告の地で仲裁するようにする英文案
たとえば、上海・東京間で取引をする際、裁判管轄が中国だけになっていたような場合、次のような対案を提示することが考えられます。
"If the respondent in such arbitration is Party A, the arbitration shall be held in Shanghai, China in accordance with the rules of the China International Economic and Trade Arbitration Commission, Shanghai Sub-Commission. If the respondent is Party B, the arbitration shall be held in Tokyo, Japan in accordance with the rules of the Japan Commercial Arbitration Association."
（被告が当事者Aのとき、上海の商事仲裁のルールに従って上海で仲裁提起しなければならない。被告が当事者Bのとき、東京の商事仲裁のルールに従って東京で仲裁提起しなければならない という意味）
